These risks include but are not limited to falls from equipment, collision with other participants, equipment malfunction, and the physical demands of gymnastics-related activities. I voluntarily assume all risks associated with my child(ren)’s participation, whether or not described above, and whether arising from the ordinary negligence of The Jungle Gym, its owners, officers, employees, coaches, instructors, volunteers, agents, or independent contractors (collectively, "Released Parties"). Waiver and Release of Liability In consideration of my child(ren) being permitted to participate in activities at The Jungle Gym, I, on behalf of myself, my child(ren), and our respective heirs, assigns, and legal representatives, hereby WAIVE, RELEASE, AND FOREVER DISCHARGE the Released Parties from any and all claims, demands, actions, causes of action, suits, damages, losses, or expenses (including attorney’s fees) arising out of or related to any personal injury, property damage, or wrongful death suffered by my child(ren) during participation in any activities at The Jungle Gym, whether caused by negligence or otherwise. Indemnification I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, damages, losses, lawsuits, judgments, costs, and expenses (including attorney’s fees) brought by or on behalf of my child(ren) or any third party arising out of my child(ren)’s participation in activities at The Jungle Gym. Rules and Supervision I agree to ensure that my child(ren) follow all rules, instructions, and safety guidelines provided by The Jungle Gym staff. I understand that during open gym and party events, parental supervision is required for children under the age of 6 unless the child is enrolled in a structured class. I certify that my child(ren) are in good health and have no physical or mental limitations that would preclude safe participation, unless otherwise disclosed above. Photo and Video Release I grant The Jungle Gym and its authorized representatives permission to photograph and/or record my child(ren) during activities and to use such images and recordings for promotional purposes, including but not limited to the website, social media, print materials, and advertising. I waive any right to compensation or approval for such use. If I wish to opt out, I will notify management in writing. Personal Belongings The Jungle Gym is not responsible for the loss, theft, or damage of any personal belongings brought onto the premises. Health and Safety Compliance I agree to comply with all facility policies, local regulations, and public health directives as may be in effect during my child(ren)’s participation in activities at The Jungle Gym. Acknowledgment and Agreement I HAVE READ THIS DOCUMENT IN ITS ENTIRETY AND UNDERSTAND THAT BY SIGNING IT, I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS. I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT. This agreement shall remain in effect for the duration of my child(ren)’s participation in any and all activities at The Jungle Gym LLC, including future visits, classes, events, and programs, unless revoked in writing.
